WHEREAS, the Asbury Park Fire Department (the “APFD”) and the Wall Township Board of Fire Commissioners Fire District 2 (the “Wall Twp. Board of Fire Commissioners”) (collectively, the “parties”) wish to enter into a Hold Harmless Agreement (the “Agreement”) which will allow the APFD to store a 1927 American LaFrance antique fire apparatus (the “apparatus”), which is owned by the APFD, at a site controlled by the Wall Twp. Board of Fire Commissioners; and

 

WHEREAS, the Mayor and City Council believe that it is in the City’s best interests to enter into said Agreement with the Wall Twp. Board of Fire Commissioners, so long as said Agreement is in a form satisfactory to the City Attorney and the City’s risk managers. 

 

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the City of Asbury Park, in the County of Monmouth, State of New Jersey, as follows:

 

1.              That the Mayor is hereby authorized to execute, and the City Clerk is authorized to attest, the above-referenced Agreement between the APFD and the Wall Twp. Board of Fire Commissioners regarding the storage of the above apparatus, so long as said Agreement is in a form that is satisfactory to the City Attorney and the City’s risk managers. 

 

2.              That a certified copy of this Resolution shall be provided to each of the following:

 

a.              Wall Township Board of Fire Commissioners Fire District 2;

b.              Fire Chief Kevin Keddy;

c.              Donna M. Vieiro, Acting City Manager; and

d.               Frederick C. Raffetto, Esq., Municipal Attorney.
