WHEREAS, N.J.S.A. 54:4-67 permits the Governing Body of each Municipality to fix the rate of interest to be charged for nonpayment of taxes or assessments subject to any abatement or discount for the late payment of taxes provided by law; and

 

WHEREAS, N.J.S.A. 54:4-67 has been amended to permit the fixing of said rate of 8% per annum on the first $1,500.00 of the delinquency and 18% per annum on any amount in excess of $1,500.00; and

 

WHEREAS, N.J.S.A. 54:4-67 has been amended to allow for an additional penalty of 6% to be collected against delinquency in excess of $10,000.00 on properties that fail to pay the delinquency prior to the end of the calendar year; and

 

WHEREAS, N.J.S.A. 54:5-19 provides that a municipality may, by resolution, provide for a tax sale no earlier than the last month of the municipality’s fiscal year when unpaid taxes or other municipal liens or charges are in arrears in the fiscal year designated in such resolution; and

 

WHEREAS, Statues further provide for the City to designate an employee who would be authorized to cancel property tax refunds/credits or delinquencies, and utility credits or balances, which are less than $10.00.

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Asbury Park, as follows:

 

1.               The Tax Collector is hereby authorized and directed to charge 8% per annum on the first $1,500.00 of taxes becoming delinquent after due date, and 18% per annum on any amount of taxes in excess of $1,500.00 becoming delinquent after due date, and if delinquency in excess of $10,000.00 remains in arrears beyond December 31st, a penalty of 6% of the amount of the delinquency shall be charged.

 

2.               Effective January 1, 2018, no interest shall be charged if payment on any tax installment is made within ten (10) calendar days following the date upon which the installment became due.

 

3.               Any payments not made in accordance with Paragraph Two of this Resolution shall be charged the interest from the tax due date.

 

4.               With respect to the Tax Sale Certificates, when the taxes, interest and costs shall exceed the sum of $5,000.00, an additional sum equal to four percent (4%) of such amount to be paid shall be added to the amount to be paid, and when that sum exceeds $10,000.00, an additional sum equal to six percent (6%) of such amount to be paid shall be added to the amount to be paid. These charges shall also apply to all existing Certificates being held by the City.

 

BE IT FURTHER RESOLVED, the City Tax Collector is hereby authorized to cancel any property tax refunds/credits or delinquencies and utility credits or balances, of less than $10.00.

 

BE IT FURTHER RESOLVED that the rate of interest to be charged for the nonpayment in full of Sewer charges not received on the due date is eight percent (8%) per annum on the first $1,500.00 of the delinquency and eighteen percent (18%) per annum on any amount in excess of $1,500.00 to be calculated from the date the sewer charge was payable until the date of actual payment.

 

BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be provided by the City Clerk to the Tax Collector, City Attorney, Chief Financial Officer and the City Auditor for the City of Asbury Park.
