Resolution Authorizing a Bike Share Concession within the City of Asbury Park

WHEREAS, the City of Asbury Park (the “City”) is interested in seeking proposals from interested vendors to operate a bike share program within the City as authorized under N.J.A.C. 5:34-9.4; and


WHEREAS, the City Attorney has provided an opinion that the concession process for a bike share program comports with the Local Public Contract Law as per N.J.A.C. 5:34-9.4(d)(1); and


WHEREAS, the requirements of N.J.A.C. 5:34-9.4(d)(2) require the following:


i.              The description of the bike share program is to create a bike share program, at no cost to the City, through a vendor soliciting advertising


ii.              The concession to be awarded is implementation and management of a bike share program


iii.              The governing body has determined that as a municipality on Transitional Aid that a concession is the most favorable method to obtain this service as it is proposed as no-cost to the City


iv.              The estimate of the total value of the concession cannot be accurately determined at this time and, the Temporary Purchasing Agent desires to err on the side of caution and bid this document


v.              There shall be a minimum payment of $1,000.00 in FY17; $2,000.00 in FY18 and $2,500.00 in FY19 to be paid to the City


Vi.              The basis of the award shall be: a) project understanding and approach constituting 50% of the basis for award; b) experience running similar bikeshare programs constituting 40% of the basis for award; c) ability to meet the proposed schedule constituting 5% of the basis for award; and d) qualifications of assigned personnel constituting 5% of the basis for award.


vii.              The estimated costs to be incurred of this concession is expected not to exceed $200 in legal review and $250 in advertising


viii.              There shall be no services or endorsements provided by the City


ix.              The governing body shall award the contract


WHEREAS, the required as per N.J.S.A. 40A:11-4.5(a) this concession shall be advertised for a period of at least twenty (20) days in an official newspaper.


NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the City of Asbury Park, that the “competitive contracting” process be implemented for a bike share program and be administered by the Temporary Purchasing Agent.


BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be provided to each of the following:


a.              Michael Capabianco, City Manager;

b.              Cindy A. Dye, City Clerk;

c.              Frederick C. Raffetto, Esq., City Attorney

d.              Michael Manzella, Transportation Manager
