              WHEREAS, a review of the public records reveals that the City of Asbury Park (the “City”) is the apparent owner of record of certain real property located at 115 De Witt Avenue (the “Property”), which is also known and designated as Block 1004, Lot 2 on the Asbury Park City Tax Map (the “Tax Map”), and which was formerly known and designated as Block 89, Lot 6 on the Tax Map; and

 

WHEREAS, the City’s ownership of the Property was effectuated through an In Rem foreclosure proceeding, which resulted in the entry of a Final Judgment dated March 15, 1996 (the “Final Judgment”); and

 

WHEREAS, the City has obtained proof that the tax lien which was issued relating to the Property, and which was the basis for the foreclosure of the Property by the City, was satisfied by the prior owner of the Property (West Side Community Center, Inc.); and

 

WHEREAS, as a result, the Property should not have been included in the Final Judgment; and

 

WHEREAS, the Mayor and City Council wish to resolve this administrative error by authorizing the City Attorney to undertake the necessary actions to effectuate the transfer of title to the Property back to the prior owner (West Side Community Center, Inc.).

 

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the City of Asbury Park, in the County of Monmouth and State of New Jersey, as follows:

 

1.              The City Attorney is hereby authorized to prepare and file the necessary documents, including but not limited to a Quit Claim Deed, in order to effectuate the transfer of title to the Property back to the prior owner (West Side Community Center, Inc.). 

 

2.              The Mayor, the City Clerk, and all other City Officials are hereby authorized to execute said documents, which shall be in a form satisfactory to the City Attorney, in order to effectuate the transfer of title to the Property back to the prior owner (West Side Community Center, Inc.). 

 

3.              A certified copy of this Resolution shall be provided to each of the following:

 

(a)              West Side Community Center, Inc.

(b)              Michael Capabianco, City Manager

                                                        (c)              Tyrone Young, Tax Collector

                                                        (d)              Erick Aguiar, Tax Assessor

(e)              Michele Alonso, City Planner

(f)              Harry Haushalter, Esq., Special Tax Counsel

(g)               Frederick C. Raffetto, Esq., Municipal Attorney
