NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Asbury Park, that Chapter II “Administration, Article V “Departments and Division”, subsection 2-8 “Police Department” of the Ordinances of the City of Asbury Park is hereby amended and that those portions of the aforesaid set forth below are hereby amended as follows and that those portions of the Ordinance not set forth below shall remain unchanged:

2-8.2              Members; Responsibilities.

              The Police Department shall not exceed more than the following:

a.              Police Chief; Number of Positions - One (1)

b.              Deputy Police Chief; Number of Positions - One (1)

c.              Captain; Number of Positions - Four (4)

d.              Lieutenants; Number of Positions - Six (6)

e.              Sergeants; Number of Positions - Fifteen (15)

f.              Police Officers Number of Positions - Seventy (70)

              The above listing represents the chain of command within the Department, with the Police Chief representing the highest position and the remaining positions falling in descending hierarchical order. The lowest ranking members of the Department shall be the Special Police Officers, if any.

In addition civilian employees including but not limited to laborers, telephone operators, clerks, computer personnel, telecommunications officers, Special Law Enforcement Officer II (SLEO), school traffic guards, and other special police officers may be hired subject to the recommendation of the Chief of Police and/or Director of Public Safety

The establishment of a Table of Organization for the City of Asbury Park Police Department shall not be deemed to require that all positions be filled, but rather the number of sworn officers in each rank and/or position shall not exceed those set forth in this article unless the Table of Organization is amended by the City Council of the City of Asbury and such positions are subject to available funding of such positions by the adoption of a budget and salary ordinance by the City Council of the City of Asbury Park. Any municipal salary ordinance, as amended, and appointment of persons in accordance with this Table of Organization shall be consistent with the foregoing and shall serve to fill the positions allowed pursuant to this section. In the event that a Police Chief is not named, then the next highest ranking officer shall have all the vested duties of that of a Police Chief.

2-8.6              Divisions.

              The Police Department shall consist of the following divisions and such other divisions and/or units as may be designated by the Police Chief:

a.              Patrol Division. The Patrol Division shall be headed by a superior officer chosen by the Police Chief, and shall consist of such officers and patrol persons as assigned by the Police Chief to carry out the duties assigned to the Division. The School Crossing Guards and Meter Enforcement Officers shall be part of the Patrol Division. This Division will be responsible for the conduct and operation of the main Police desk and such other duties as determined by the Police Chief.

b.              Administrative Service Division. The Administrative Services Division shall be headed by a superior officer chosen by the Police Chief, and shall consist of such officers and patrol persons as assigned by the Police Chief to carry out the duties assigned to the Division, which duties shall be determined by the Police Chief.

c.              Investigation Division. The Investigation Division shall be headed by a superior officer chosen by the Police Chief, and shall consist of such other detectives and officers as assigned by the Police Chief to carry out the duties assigned to the Division, which duties shall be determined by the Police Chief. The grade of Detective shall be of a temporary nature and shall apply to patrol persons when assigned by the Police Chief to the Investigation Division of the Department. In the absence of a superior officer, detectives shall rank patrol persons in carrying out their duties.

d.              Support Services Division. The Support Services Division shall be headed by a superior officer chosen by the Police Chief and shall consist of staff support to perform duties included but not limited to Records, OPRA, Technical Services, etc.
